On Tuesday, the San Jose city council overwhelmingly approved gun control restrictions mandating every resident who owns a gun to pay an annual fee of $25 per household. In addition, gun owners are required to carry liability insurance for the gun that “specifically covers losses or damages resulting from “any negligent or accidental use of the firearm” in six months, according to the ordinance.
San Jose Spotlight reported that city council members voted 10-1 to pass the insurance liability mandate with the annual fee for guns passing 8-2.
There is an estimated 50,000-55,000 households in Jose with guns which will result in approximately $1.3 million per year in revenue to the city for the annual fee.
San Jose Mayor Sam Liccardo introduced the legislation back in 2019 following the mass shooting at the Gilroy Garlic Festival but it was stalled due to the outbreak of COVID in 2020. He resurrected the bill in 2021 after the mass shooting at the VTA light rail yard.
“When we think about the horrible mass shootings, I don’t pretend to know that we could have stopped it or not. But if in fact, we could have delivered some mental health services, there may have been a chance,” Liccardo said. “That’s the point of this (legislation).”
The law provides for the roughly $1.3 million annual revenue from the fees to be sent to a nonprofit to distribute funds to other organizations providing “evidence-based solutions” to gun violence, like mental health services, addiction services, suicide prevention, firearm safety training and victim compensation.
It all sounds well and good except that there is no nonprofit of this nature established yet so there is nowhere to send the funds. The opportunity for corruption in setting up a non-profit after the fact with no outline of logistics and oversight is disturbing to say the least.
Additionally, insurance companies to not have gun liability policies that meet the law’s requirements.
The lone dissenting vote on the insurance portion of the law was cast by Council member Dev Davis.
“I spoke with two insurance agents including my own from different companies and neither of them said that negligence use is specifically covered in their policies,” Davis said. “I’m still not certain how we can require a specific type of insurance that does not exist.”
The City is already threatened with lawsuits over the law.
Sam Parades, executive director of Gun Owners of California, stated prior to the vote that he already had a “dream team” of Second Amendment advocates that plan to sue the city.
“This will have zero to less than zero impact on reducing gun violence or paying for the results of gun violence,” Parades said. “There isn’t an insurance policy that exists out there that would cover that.”
Leave it to liberal lawmakers to burden law abiding American citizens with fees and regulations to exercise their constitutional right and for which the same governing municipality does not have the means to implement or enforce.
We’ll see how long it takes for the lawsuits to be filed. If this law is upheld you can bet every liberal city in the country will jump on the bandwagon.
