For months after the inauguration of Supreme Court Justice Amy Coney Barrett the photo of the Justices on the official website still contained liberal favorite, Justice Ruth Bader Ginsburg, ABC News reported.
That was because, due to the COVID-19 restrictions in place in Washington, D.C., the justices could not get together.
But all nine of the current Supreme Court Justices met for the first time, maskless, on April 23.
It was the first time Justice Barrett was pictured alongside the other two Trump nominees, Neil Gorsuch and Brett Kavanaugh.
But what is far more important than their photograph is what these justices, along with Justice Clarence Thomas and Justice Samuel Alito, and perhaps even supposed conservative Chief Justice John Roberts, can do together, especially on abortion.
The U.S. Supreme Court has agreed to hear a challenge to a Mississippi law that bans nearly all abortions after the 15th week of pregnancy.
It will be the first abortion case to be argued before the Supreme Court since Justice Amy Coney Barrett was confirmed, potentially providing a pathway to challenging Roe v. Wade and allowing outright bans on abortion.
The court will consider the heart of Roe by hearing arguments on whether all bans on abortion prior to the point of fetal viability are unconstitutional.
The Mississippi ban included exceptions for medical emergencies or a “severe” fetal abnormality, but not cases of rape or incest.
A federal judge blocked the Mississippi law shortly after its passage in 2018, and the 5th Circuit Court of Appeals — among the country’s most conservative appeal circuits — upheld that decision last year, citing the precedent set by Roe.
It would seem that Barrett will be the ultimate vote on this.
Late last year, President Donald Trump announced was interviewed on Fox & Friends Weekend and was asked if he wanted Roe v. Wade overturned.
“So I didn’t think it was for me to discuss that with her because it’s something that she’s going to be ruling on and this is what I was told, although I would have had the right to do that,” Trump said.
“But if you look at her past actions, rulings, I guess she maybe would be in the category you mentioned, I don’t know. I can say this, that she is certainly conservative in her views, in her rulings, and we’ll have to see how that all works out, but I think it will work out,” Trump added.
Hegseth then asked whether Trump thought a court with an apparent conservative majority of 6-3, with half of the conservatives the president’s own appointees, “would potentially rule on a life issue.”
“Well, it’s certainly possible. And maybe they do it in a different way. Maybe they’d give it back to the states. You just don’t know what’s going to happen,” Trump said.
Trump, who has appointed Justice Neil Gorsuch and Brett Kavanaugh to the Supreme Court, said that justices cannot always be judged by their track records.
“I’ve been surprised by some of the rulings that we’ve already had over the last year. You know, you think you know somebody and then you get rulings federal a little bit different than you think could happen,” Trump said.
“So you never know what’s going to happen,” he added.
