Her remarks as co-host of Fox News’ midday panel talk show “Outnumbered” came after Biden referenced former President Donald Trump’s agenda and supporters in a politically charged way as he commented on the leak of a preliminary Supreme Court draft decision that overturns the landmark 1973 Roe v. Wade case that legalized abortion in all states.
In addressing the unofficial ruling, the president said it’s “about a lot more than abortion” before claiming that the “MAGA crowd” is “the most extreme political organization that’s existed in recent American history.”
“This reminds me of the debate with Robert Bork. Bork believed the only reason you had any inherent rights was because the government gave them to you,” Biden recalled. “When I was questioning him as the chairman, I said, ‘I believe I have the rights that I have not just because the government gave them to me, which you believe, but because I’m just a child of God—I exist.’”
“So, the idea that somehow there is an inherent right, that there is no right of privacy, that there is no right,” he said. “There’d been a law saying a married couple could not purchase birth control in the privacy of their own bedroom and use it. Well, that got struck down.”
Biden was referencing the case Griswold v. Connecticut, which he said “was thought to be a bad decision, by working on, my guess is, the guys on the Supreme Court.”
“Now, what happens if you have states changing the law, saying that that that children who are LGBT, who can’t be in classrooms with other children, is that is that legit under the way that the decision is written?” Biden asked in a bizarre hypothetical.
“What are the next things that are going to be attacked?” he said before adding: “Because this MAGA crowd is really the most extreme political organization that’s existed in American history—-in recent American history.”
In response, McEneny compared Biden’s incendiary remarks with similar comments made on Tuesday by Joy Behar, a co-host of “The View” on ABC.
“Joe Biden sounds a lot like Joy Behar, and it’s never a good thing to sound like joyless Behar. But Joy Behar said, ‘My worry is that this is just the beginning. Next, maybe Brown versus Board of Education.’ Brown versus Board of Education, as almost all of our viewers know, says, separate but equal is inherently unequal and led to the integration of schools,” the attorney and former press secretary said.
“To at all suggest that, as Biden did, that all of these other cases are under threat – Joy Behar, that integration of schools would be under threat? It’s cringeworthy, but it’s expected,” she added.
“Take the president at his word. Just yesterday, he talked about the aborting of a child. He used the word child. He’s correct. It is a child. So good for him for having a moment of honesty there,” McEnany noted further.
“But the rhetoric you’re hearing from the left, [NBC’s] Yamiche Alcindor in the White House Press Corps, here’s what she said: ‘Women will be forced to have pregnancies that will turn into children.’ Let that sink in. This is where we’re at,” McEnany noted.

Earlier, Biden said he wanted to be clear on three points about the cases before the Supreme Court.
“First, my administration argued strongly before the Court in defense of Roe v. Wade. We said that Roe is based on ‘a long line of precedent recognizing ‘the Fourteenth Amendment’s concept of personal liberty’… against government interference with intensely personal decisions.’ I believe that a woman’s right to choose is fundamental, Roe has been the law of the land for almost fifty years, and basic fairness and the stability of our law demand that it not be overturned,” he argued.
“Second, shortly after the enactment of Texas law SB 8 and other laws restricting women’s reproductive rights, I directed my Gender Policy Council and White House Counsel’s Office to prepare options for an Administration response to the continued attack on abortion and reproductive rights, under a variety of possible outcomes in the cases pending before the Supreme Court. We will be ready when any ruling is issued,” the president said.
“Third, if the Court does overturn Roe, it will fall on our nation’s elected officials at all levels of government to protect a woman’s right to choose. And it will fall on voters to elect pro-choice officials this November. At the federal level, we will need more pro-choice Senators and a pro-choice majority in the House to adopt legislation that codifies Roe, which I will work to pass and sign into law,” he added.
