At a press conference Tuesday following a report Monday evening by POLITICO detailing the draft opinion, DeSantis referred to the unprecedented leak as an act of “judicial insurrection.”
The GOP governor joined with other political leaders, mostly Republicans, who have said they believe the lead was intended to pressure the justices to change their minds.
“I think it was really an attack on a lot of the justices,” DeSantis said Tuesday afternoon. “I think it was an intentional thing to try to whip up a lot of the public, try to make it very political, potentially try to bully them into changing one of their positions.”
“That is not something that is appropriate for the judicial branch,” he said. “I know they launched an investigation, they need to figure out who did that, and they need to hold them accountable because that is a real significant breach of trust.”
He went on to emphasize that he was “really surprised” by the unprecedented leak noting, “You wanna talk about an insurrection, that’s a judicial insurrection, to be taking that out and trying to kneecap a potential majority through kind of extra-constitutional means.”

POLITICO broke the news Monday evening that a majority of justices on the nation’s high court have chosen to strike down the landmark decision, reporting that Justice Samuel Alito had written a draft in February that is an “unflinching repudiation” of Roe v. Wade.
The draft majority opinion, which is not final, says Roe v. Wade was egregiously wrong.
“We hold that Roe and Casey must be overruled,” Alito wrote. “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”
Others agreed with DeSantis on a possible motive for the leak.
“The leak appears to be totally political in nature, not only intended to damage the Court and pressure the justices, but more immediately to incite Democrats to push their laundry list of terrible anti-life ideas, including blowing up the filibuster and attempting to codify abortion violence at the federal level prior to the November elections,” Katie Glenn, Government Affairs Counsel at Americans United for Life (AUL), told The Daily Wire.
As angry conservatives demanded an investigation into who may have leaked the draft, CNN reported that a notable ‘conservative’ justice was missing.
According to the network, Chief Justice John Roberts’ name was missing from the majority ruling that was written by Justice Samuel Alito.

It appears that five justices would be voting to overturn Roe. Chief Justice John Roberts did not want to completely overturn Roe v. Wade, meaning he would have dissented from part of Alito’s draft opinion, sources tell CNN, likely with the court’s three liberals.
“That would mean that the five conservative justices that would make up the majority overturning Roe are Alito and Justices Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett,” CNN noted further.
The ruling was in response to a Mississippi law that bans all abortions after 15 weeks. CNN said that according to other court sources, Roberts was on board with allowing the Mississippi law to stand, just not to overturn Roe altogether.
And to that point, the majority draft opinion also does not ban abortions outright, but merely returns the issue to states where it resided before Roe.
Earlier in the day, Roberts confirmed the document was authentic and said an investigation is underway to discover who leaked it.
“This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here,” he said in a statement, noting that he has “directed the Marshal of the Court to launch an investigation into the source of the leak.”
