() U.S. Supreme Court Justice Clarence Thomas has rejected a case from a man who argued his generalized anxiety disorder prevented him from wearing a mask.
by , July 15th, 2021
Lucas Wall filed a lawsuit challenging the Centers for Disease Control and Prevention’s mandate requiring masks on public transportation.
Thomas rejected the request for an injunction without referring the case to the rest of the court, CNN reported.
“Of course it’s still disappointing Justice Thomas did not take a more in-depth look at the illegal and unconstitutional mask requirement,” Wall said.
Wall filed his lawsuit after he was removed from the Orlando International Airport in June for not wearing a mask.
Thomas considered the request given he is in charge of overseeing the appeals circuit that includes Florida, where Wall’s initial lawsuit was filed.
He argued in his complaint to the court that his “generalized anxiety disorder” made it impossible for him to follow the “improper, illegal, and unconstitutional” mandate.
And even though Thomas shut down his appeal, Wall said he still believes he will win his case against the agency eventually.
“For now, the federal government has prevailed in muzzling all travelers and banning tens of millions of Americans including myself who can’t tolerate having their face covered from using any form of public transportation,” he said.
Republican Sen. Rand Paul is fighting back against the Biden administration’s federal mask mandate, which remains in place despite the lifting of similar restrictions in many states.
The mandate, which was put in place by the Transportation Security Administration (TSA), requires that all airline travelers wear masks on airplanes with limited exceptions.
The current mandate lasts until Sept. 13.
The Kentucky senator intends to introduce legislation to revoke it.
“When the Senate returns to session, I will be introducing an immediate repeal of the mask mandate on planes. Enough! Time to stop this farce and let people travel in peace!” Paul tweeted last week.

Paul’s announcement comes in the wake of a letter by three Democrats and two Republicans who sent a letter to both the TSA and the Centers for Disease Control and Prevention asking them for details on how they plan to update their mask requirement for fully vaccinated travelers.
To date, neither federal agency has clarified how the previously implemented mask mandate affects travelers who’ve already been vaccinated.
Paul has, for months, questioned public health experts like Dr. Anthony Fauci and other members of the Biden administration on the restrictions put in place over the COVID-19 pandemic.
Paul, a physician by practice, has been a vocal opponent to the mask requirement for anyone who is already vaccinated, or who has already contracted and recovered from the illness.
Republican Florida Gov. Ron DeSantis also took another stand to help those who have been affected by the COVID-19 restrictions in his state.
The governor granted clemency to two Broward County gym owners who did not enforce the mask-wearing mandate.
“I was actually just recently briefed on this case and we looked at it and so I’m glad you have Mike and Jillian on, and I’m also glad to be on to be able to say that effective tomorrow morning, I’m going to sign a reprieve under my constitutional authority,” DeSantis said to Fox News host Laura Ingraham, who also had the gym owners on the show.
“So that will delay the case for 60 days against both of them, and then when our clemency board meets in the coming weeks, we’ll issue pardons, not only for Mike and Jillian but for any Floridian that may have outstanding infractions for things like masks and social distancing,” he said.
