A preview of Garland’s submission to the committee, first reported by Politico, shows that the Chicago-native will call the January 6 riot “a heinous attack.”
“If confirmed, I will supervise the prosecution of white supremacists and others who stormed the Capitol on January 6—a heinous attack that sought to disrupt a cornerstone of our democracy: the peaceful transfer of power to a newly elected government,” he is expected to say.
Today, during his confirmation process, the failed Supreme Court nominee, Merrick Garland, told Senator Josh Hawley (R-MO) that he doesn’t consider the attacks on a federal courthouse “domestic terrorism” because they happened at night.
“Do you regard assaults on federal courthouses as acts of domestic terrorism?” Senator Hawley asked Garland.
Merrick Garland responded, “An attack on a courthouse while in operation, trying to prevent judges from deciding cases, that clearly is domestic extremism…domestic terrorism. An attack simply on a courthouse at night or any other kind of circumstances is a clear crime and certainly should be punished.”

According to Garland, Trump supporters who entered the Capitol building on January 6 (It cannot be overstated that most of the people who entered the Capitol building on January 6th were non-violent and simply walked through the halls of Congress) are “white supremacists,” but his definition of Antifa, a group with a long history of extreme violence, would depend on the time of day that the violence took place.
