Attorneys for Hillary Clinton’s presidential campaign lawyer filed a motion Thursday to dismiss special counsel John Durham’s case against him, calling the matter “extraordinary prosecutorial overreach.”
The lawyer, Michael Sussmann, was charged last year in Durham’s Trump-Russia investigation after he was accused of lying to an FBI agent when he told them he wasn’t advising Clinton’s 2016 presidential campaign.
In the motion to dismiss, Sussmann’s legal team said he did not make false statements to the FBI — and argued that prosecutors were pursuing him on a technicality.
His lawyers argued that Sussmann voluntarily met with FBI agents in September 2016 to “pass along information that raised national security concerns.”
Sussmann had raised concerns with the FBI about purported ties between the Trump Organization and Moscow’s Alfa Bank. Further review suggested the supposed digital fingerprints were likely the result of junk email.
“He met with the FBI, in other words, to provide a tip. There is no allegation in the indictment that the tip he provided was false. And there is no allegation that he believed that the tip he provided was false,” the motion says.
This past weekend Durham released notes showing that Hillary’s team, which included Sussmann, was spying on the President of the United States, Donald Trump. Most Americans believe that spying on the President is not an immaterial matter.
Perhaps Sussmann’s attorneys believe that Sussmann’s actions were immaterial, but when connected to the grander scheme of attempting a coup of the President of the United States, Sussmann’s lies may very well be material.
This is not good for Sussmann or Hillary. This is why he wants to get out of it now.

LOTS of articles presented here on SITS from TGP, which can hardly be considered an “unbiased source.” Sussman is responding in an appropriate way if you understand “legalese.” An INDICTMENT and a CONVICTION are, quite often, TWO DIFFERENT THINGS. Most are politically motivated, others are actually about facts and the process of law itself. No matter how much you may like or dislike the “machine” that we have come to know as HRC, the proof, as always, will be in the pudding. This is one to watch for sure, but no-one in their right mind would think that the “machine” known as HRC would be so poorly oiled as to not cover a base (or two, or three) such as this. It is all hyperbole, conjecture, and optics until facts (ACTUAL FACTUAL) bear out the case. Can the facts bear out a knowingly corrupt court system? Only time will tell…….
